Terms of service
263tickets serves four kinds of people, and the terms differ by role. Read the general terms, then the section that applies to you — consumer, organiser, third party, or distributor. Each section gathers the agreements and policies that govern that role.
Who these terms cover
263tickets is a marketplace that connects event organisers with the people who attend their events. Depending on how you use it, one or more of the role-specific sections below applies to you. The general terms in this section apply to everyone.
By using the platform — buying a ticket, listing an event, calling our API, or selling printed stock on our behalf — you agree to these terms and to the privacy and community policies. You must be able to form a binding contract to use 263tickets, you must give us accurate account information, and you're responsible for activity under your account.
Browsing, purchasing, interacting with other attendees, and your privacy.
Account and event creation, payment processing, refunds, and data privacy.
Developers, IP owners, and our vendors, processors, and subprocessors.
Selling printed tickets at a physical location for walk-in buyers.
Some roles also sign a separate agreement when they set up — organisers a Merchant Agreement and Data Processing Addendum, distributors a Distributor Agreement, API partners the API Terms of Use. Those agreements are incorporated into these terms by reference, and where a signed agreement conflicts with the matching section below, the signed agreement controls.
Consumer terms
For attendees: browsing, purchasing, interacting with other attendees, and your privacy.
Consumer terms of service
A ticket is a revocable licence to attend an event under the organiser's conditions — not a transfer of ownership, and not a guarantee against changes the organiser makes. Prices, availability, age limits, and the line-up are set by the organiser and shown to you before you pay. We deliver and validate the ticket; the organiser runs the event and owns its refund policy.
Keep your ticket and its QR code private — anyone who presents it first may be admitted, and a ticket scanned once will not scan again. Transfer and resale are allowed only where the organiser has enabled them for that event, and never above face value. Reversing a legitimate charge, using stolen payment details, or buying to resell can void your tickets and suspend your account.
Your privacy
We collect only what we need to deliver your tickets, process payments, prevent fraud, and — where you've consented — keep you posted on events you care about. Messaging consent is recorded with its source and time, and a STOP reply on WhatsApp unsubscribes you from that channel immediately. The full detail of what we collect, why, and who we share it with is in the privacy policy.
Community standards
When you review an event, post in an event feed, or message an organiser, you agree to be honest and to treat other people with respect. Fake reviews, harassment, hate speech, and content that targets people for who they are are removed, and repeat breaches cost you your account. The standards in full are in the community guidelines.
Your data-protection rights
Under GDPR, POPIA, and Zimbabwe's Cyber and Data Protection Act, you can ask for a copy of your data, ask us to correct it, ask us to delete it, and object to or restrict certain processing. We action verified requests within 30 days. To exercise a right, email privacy@263tickets.com. When you buy a ticket, the event's organiser also receives your details as an independent controller — their own use of your data is governed by their privacy practices.
Organiser terms
For organisers: account and event creation, payment processing, refunds, and data privacy.
Merchant agreement
When you sell tickets through 263tickets you are the seller of the ticket and the merchant of record for the event; we facilitate the sale, collect payment on your behalf through our supported rails, and pay it out to you less our disclosed fees. You are responsible for the event itself, for any taxes due, and for honouring every valid ticket at the door.
Payouts settle to your nominated account on the agreed schedule. We may hold, delay, or reverse a payout, and recover funds already paid out, to cover refunds, chargebacks, disputes, or suspected fraud. You warrant that you hold the rights to everything you list and that your event is lawful, and you indemnify 263tickets against claims arising from your event or your breach of these terms. A separate Merchant Agreement signed at payout setup carries the full commercial terms and controls if it conflicts with this clause.
Data processing addendum
For the attendee personal data you receive through the platform, you are the data controller and 263tickets is your processor. We process that data only on your documented instructions and only to provide the service, apply appropriate security measures, and help you respond to data-subject requests and personal-data breaches.
You instruct us to engage the subprocessors we publish, we impose equivalent data-protection obligations on each, and we give you notice of any change so you can object. On termination we return or delete the attendee data we hold for you, save what we must keep by law. Cross-border transfers are made under safeguards appropriate to the markets involved. These obligations bind both of us under GDPR, POPIA, and Zimbabwe's Cyber and Data Protection Act; the full standard terms are published as our Data Processing Addendum, and a signed copy carries the complete commercial terms.
Refund-policy requirements
You must set and publish a refund policy before you sell a single ticket, and you must honour it. Your policy can be stricter or more generous than our baseline, but it can never fall below the consumer-protection law of the markets you sell into.
Where an event is cancelled, materially changed, or found to be fraudulent, refunds are mandatory regardless of your stated policy. In those cases — or where you fail to action a refund you owe — 263tickets may issue the refund to the buyer directly and recover the amount from you, including from held or future payouts.
Our subprocessors
To run the marketplace we rely on a small set of vetted providers that may process personal data on our and your behalf: our payment providers (EcoCash and InnBucks), our messaging and email providers, our cloud hosting and file storage, and our search, analytics, and observability tooling. Each is bound by data-protection obligations equivalent to ours.
We publish a current list of these subprocessors and notify organisers before adding or replacing one. See the subprocessors list, or email privacy@263tickets.com to raise an objection.
Third-party terms
For developers, IP owners, and our vendors, processors, and subprocessors.
API terms of use
Access to our public API is granted under the credentials we issue and the scopes attached to them. Stay within the documented rate limits, request only the data your integration needs, and handle any attendee or organiser data you touch under the same privacy and security obligations we hold ourselves to. Don't reverse-engineer, scrape, resell, or rebuild the platform, and don't use the API to compete with the service it's part of.
The API is provided as-is, and we may change, deprecate, rate-limit, suspend, or revoke access to protect the platform or its users. Where a separate partner agreement is in force, that agreement controls if it conflicts with this clause.
Trademark & copyright policy
The 263tickets name, logo, and brand are ours. You may not use them in a way that implies endorsement, partnership, or sponsorship we haven't agreed to in writing, or that could confuse people about who's behind a product. Organiser and attendee content stays the property of whoever created it; by posting it you grant us the licence we need to display and distribute it across the marketplace.
We respect intellectual-property rights and expect everyone here to do the same. If you believe content on 263tickets infringes your trademark or copyright, send a notice with the details and proof of your rights to ip@263tickets.com. We act on valid notices, allow a counter-notice where appropriate, and terminate repeat infringers.
Distributor terms
For organisations selling printed tickets at a physical location for walk-in buyers.
The distributor role
A distributor sells printed tickets to walk-in buyers at a physical location on an organiser's behalf. These are not online tickets — they are printed copies handed out at your counter — but every one is integrated into 263tickets the moment it sells, so it can be scanned and verified at the gate exactly like a ticket bought online.
That integration is the whole point: a printed ticket is only valid once it has been activated in the platform at the point of sale. An unactivated printed ticket will not scan, and a serial reported lost or stolen is voided.
Your obligations
As a distributor you agree to:
Register every sale
Each printed ticket is activated in the platform at the point of sale, so it carries the same verifiable identity as an online ticket and can be scanned at the gate.
Protect the stock
Unsold and blank ticket stock is kept secure. Lost, stolen, or duplicated stock must be reported immediately so the affected serials can be voided.
Settle on time
Proceeds from walk-in sales are reconciled and settled to the organiser through the platform on the agreed schedule, in the currency collected.
Sell only what's allowed
Tickets are sold at the face price and within the allocation the organiser assigns to your location. No mark-ups, no over-issuing beyond the allocation.
Stock, settlement & authority
You hold ticket stock as the organiser's agent, not as its owner. Your authority to sell ends when your allocation is exhausted or the organiser withdraws it, and you remain accountable for every serial issued to your location until it is sold, returned, or voided.
The distributor programme rolls out alongside walk-in sales; until then this section describes the contract a distributor signs on joining. A signed Distributor Agreement carries the full commercial and custody terms and controls if it conflicts with this clause.
Payments & fees
Payments are processed through our supported rails — EcoCash and InnBucks today, with card via ZimSwitch coming soon — and settle in the currency shown at checkout. Fees are disclosed before you pay or, for organisers, in your dashboard. We never receive or store card numbers, CVVs, or mobile-money PINs; the rails authorise each charge on their side and return only a payment reference. When card acceptance goes live, card data will flow through the provider's own secure page and never touch our systems.
Liability
To the extent permitted by law, 263tickets is not liable for an organiser's acts or omissions, a distributor's handling of printed stock, an event being cancelled or changed, or losses outside our reasonable control. We provide the platform as-is and don't warrant that it will be uninterrupted or error-free. Nothing here limits liability that can't be limited under the law of your market — including for death or personal injury caused by negligence, or for fraud.
Changes
We may update these terms as the platform evolves — including as the distributor programme moves from contract to live walk-in sales. Material changes are announced, the date at the top of this page always reflects the current version, and continued use after a change takes effect means you accept it.
